InterLocal Pension Information

GCC/IBT Interlocal Pension Fund Chairman, John Agenbroad
visited on April 17th in Commerce to provide information on the pension fund and answer questions regarding the fund.

This pension is the only 501 C18 in the country. It was founded in 1950 and the fund is overseen by union trustees , NO company trustees. There is in fact absolutely no involvement by the company in any way with regards to the fund, its investments or the administration of the fund.

The Fund's assets were reported in 2007 of the 57th Annual Report of The Trustees to be approximately 1.8 Billion dollars.
John stated the current assets are reported to be 1.4 billion dollars.The administration fees are a mere 4% which is unbelievable for a fund with the assets that are in the ILPF.

Full retirement benefits at age 65. Of course early retirement is possible with the normal percentage of reduced benefits based on years retired prior to 65th birthday and length of participation in the fund.

The fund also contains a Disability Benefit once your account reaches a balance of $1500.00, everyone qualifies regardless of age.

The plan uses a unit based scale, 1 unit equaling $260.00. Once your account reaches a balance of $260.00, you are 100% vested. Monthly contributions are made on an after tax basis and contributions can be deffered when filing your income taxes. All members equally contribute an agreed monthly percentage of their gross monthly income. It also allows you to automatically contribute more when overtime is worked. There is currently a $7000.00 annual limit which the Teamsters are currently lobbying to increase to the same $16,500.00 limit applied to 401k's. We are told this may occur soon which will allow our members to increase their annual retirement investments.

The plan invests in equity funds, domestic and international that are screened through the AFL-CIO to insure there are no labor issues with the countries, companies or businesses that receive our union investments. The Fund will not invest in oppressed countries and never has, nor will it ever invest in hedge funds.

There has been 11 increases in benefits in a thirty year period with only 1 decrease over the same period. How many times have we had our benefits reduced until now that they're completely gone. Companies have abandoned their responsibility to provide retirement dollars to their long term valued employees, its now up to you to take care of your retirement investments.

There is also portability with the fund for up to two years if leaving the company. You may continue to contribute for up to two years at which time you may continue to participate in the fund if you remain in the printing industry, regardless of the new employer or whether employment is under union contract.

These are some of the main highlights of the Interlocal Pension Fund based on Chairman Agenbroad's presentation and questions asked by the members who actually took the time to attend this very important meeting. I was disappointed that Chairman Agenbroad, who also happens to be Mayor of Springboro, Ohio, took time from his busy schedule to come and meet all of you and bring such valuable information for your retirement future and there were an abundance of empty chairs.

With all the bullshit that has resulted as a result of ratifying the contract, the economy and the health of the newspaper industry, the ability to invest in the Interlocal Pension Fund will certainly make up for loss of the inferior retirement vehicles provided by the company.

The literature they possess are the Summary Plan Description and Trustee Indenture, The 57th Annual Report of the Trustees, an informative fund overview pamphlet and the Table of Benefits based on number of units.

I challenge everyone to take these documents to their financial consultants and/or tax preparers for their professional opinion of the information contained therein and whether they believe there is a comparable plan that you can invest in. I hope at least some of you accept this challenge and report your findings to Keith or myself to publish here. Don't you think you should at least investigate this plan and whether or not you can better invest your retirement savings elsewhere?

Chairman Agenbroad is willing to return and answer your questions and provide answers if any of you are interested and aren't too busy to be concerned about your retirement because you're all so freaking young. I will only ask him to return if commitments to attend are received.

We need to vote on participating in this fund so I suggest everyone get the necessary information literature from Keith, Charlie or myself and at least take advantage of one of the benefits of organizing that mangement can't screw with. Take responsibility for the future.

Rumor Control

I have been asked to respond to some of the current rumors floating around in the shops. The first thing I want to say is, I am only doing this because I was asked to and not because I need to defend myself from the same rumor mongers that have perpetuated the lies against me time and time again.

First fact is, I have not been hired by the Teamsters nor have I been offered a job by them.
If I had a buck for every time that was said or assumed, I could have retired long ago.

Second fact, I am NOT drawing a salary from Local 140-N nor the Teamsters. I am still on disability as a result of the shoulder injury I suffered in November 2008. I know there were some of you that thought I was milking it on light duty while working in the office. A recent MRI revealed a tear in my rotator cuff and I will be undergoing surgery soon to repair my shoulder. We all know who takes advantage of light duty, and I was not one of them. Don't forget I returned to the press in less than 7 months after a full knee replacement. I doubt my critics would have returned as quickly.

The Constitution does allow for officers to receive a salary, but as I stated to the Constitution and By-Laws Committee, It makes no sense for me to accept a salary from our Local when on disability because my disability benefits would be reduced by the same amount. So, I am forgoing any salary the Constitution authorizes me to receive at this time. For the record, a salary has not even been established by the Executive Board. None of the officers are receiving a salary at this time as all of our resources are committed to Attorney expenses attempting to resolve our conflicts with management. None of the shop stewards or officers are having their dues paid by the Local at this time either.

Next, there is nothing in the constitution that states I or any of the officers will receive a car. The Local does not require it's officers to need a business vehicle. We on the E-Board have agreed that our own vehicles will suffice. There are provisions for fuel and/or mileage reimbursement for officers travels in the course of their duties.

The Constitution does provides for a "per diem" of $100.00 dollars a day for Officer's meals and beverages when attending International Conferences representing the members of Local 140-N. Any unused portion will be returned to the Local's Secretary Treasurer.

I hope this puts to rest the B.S. that has been floating around lately because it only serves to divide our members. My reputation and integrity are just as important to me today as it was my last day I set foot on the pressroom floor.

De-Authorization Petition Blocked

On Friday April 10, 2009 GCC/IBT Local 140-N received a notice from the N.L.R.B. that Orange County Operator, Lee Carey filed a Petition for a de-authorization election. The purpose of de-authorization is to have the union security and dues check-off language stripped from the contract. The remainder of the contract remains in force.

Although Carey, Saterlee and Espinosa have the right, their motives are again questionable at best.

Our Attorney informed our Local that our pending board charges serve to block the attempt to have the Board grant an election at this time. We have also informed the board that we are challenging the petition and charge that the solicitation of signatures was tainted. This will prevent the petition from being considered at a later time when current charges are addressed by the board.

More on this subject as it progresses.

Unemployment Contact Information and More

Several calls were received inquiring about Union contact information for Unemployment applications. Our Secretary Treasurer Linard Williams asked that we use the following address and phone number :

For those currently employed, this address should also be used for sending Beck Objections for Agency Fee Payer dues as described in an earlier post and mailing. This is a requirement under the International Constitution and must be completed in writing in order to pay reduced monthly dues.

Also, the names and dues check-off applications of approximately 16-19 individuals were given to management, (Russ) on two separate occasions, which he claims to have not received. Linard hand delivered the forms and dues deductions will begin on the next deduction cycle.

Anyone having not submitted an authorization form can send any dues that are in arrears to the address above in the amount of $60.00 for the months of February and March. Dues are deducted on the second pay period of each month, so April's dues are due soon and can be included also. A letter informing those who have chosen to ignore their dues obligation will be notified and given an opportunity to bring their dues current. The Local will after that time begin to persue legal action to recover the delinqent amount owed to the Local and that future dues are to be received by the Secretary Treasurer when due.

Dues refunds are expected to be sent to any of the 63 employees laid off that were having dues automatically deducted prior to being disgracefully shown the door. Use the number above to contact Linard to see if your dues refund is on it's way.

Who's Next?

Hello Brothers and Sisters,
Has any one noticed how the company has allowed division to be prevalent from one plant to the other, a divide and conquer system for many years? We have two plants with two totally different management styles. We all know it and it has worked to some degree. How do we feel that our friends for many years are being laid off with nothing? I bet a lot of you are just glad it was not you. But, can someone please tell me what's so good about this place since the Tribune and now Zell have taken over the paper? You guys who are still on the fence, were you one of the companies special pressmen that they wanted to protect in negotiations? We know we have lost a lot of good people over the last two layoffs. As good as some were, this paper has yet to miss a delivery when they or your good ass was gone, vacation, sick, or whatever. Most of us grew up in the 60's and 70's, where brothers helping brothers. We all pulled together to get the job done. We are still our brothers keeper...I still think so. Right now, this country has lost it way. We no longer think as we, but, me. Really, can you honestly tell me or anyone what this
new regime has brought to you. We have newspapers failing all around us but, we could not pickup one or two products. Maybe if they concentrated more on that verse eliminating jobs or fighting to get the union out, they could. You sit comfey because of your seniority number and don't want to get involved but, we are all involved...up to our neck. That security you are afforded by this contact, as weak as it is one reason why. This regime has taken us for granted. All the many years of sacrifices we have all made, missing, holidays, kids games, family get togethers, and sickness. Some people think we are paid too much but, they are not here on those missed days with our families. And yes, we have been paid well but, so have they. The current situation at this company was not brought on by the union. We just wanted the slashing to stop to get some type of security. We are fighting the corporate greedy giants all over this great country. This company has been poorly managed over the years. All that money spent on road shows, private meetings with supervision all to stop us from having a right given to all in this America. That my friends was not even needed if in fact the company was treating us so well.

Yes, some people are thinking of their own gain. But, how does that effect you and me? I put in an honest days work for a customer who I can neither see nor talk to and this does afford my family the necessities of life. Don't lose your integrity. We all need to pull together. This union is here now, and I hope to stay for at least two and a half years hopefully more. Let's all make the best out of this situation, you might like it down the road. United we stand divided we will fall. Recognize who is on your side...your fellow workers as neighbors are. The tactics this company has used, have misfired thus far but they have devastated a once grand paper and our friends lives. Who's next? We must stand together and support our brothers and sisters as ourselves.

Agency Fee Payer Information

The following documents were mailed to everyones home to provide information regarding non-member dues and the process to become a "financial core member" The letter explains the member advantages that are forfeited when full membership is not desired by the employee.

The dollar amount of monthly dues for an "Agency Fee Payer" member is $48.04. The formula is based on $60.00 per month that a full member pays which includes the International per capita at the chargeable amount rate of 80.06%. This amount is deductable through "dues check-off" by completing and submitting a dues check off authorization form.

Union Update

March E-Board Meeting

The e-Board met last week to discuss myriad of topics concerning our shops, grievances filed with the company and board charges filed with the N.L.R.B. as well as our new Local's Constitution and By-Laws. The Board was in favor of having another Rally at the Downtown L.A. Times Headquarters in response to the company's decision to withhold severance for 63 pressroom employees. The company's decision to lay off 63 long time employees without any severance is a blatant act of retaliation for exercising our right to form a Union.

March 30, 2009 Rally

We said we'd be back at the conclusion of the February 23rd Rally and as a result of the company's unwillingness to offer severance to 63 soon to be former pressroom employees. We have multiple Board charges filed with the N.L.R.B. regarding the company's "Bad Faith Bargaining over severance. We hope to have a decision soon.

We will once again meet on the corner of 1st and Spring at 11:30 am on Monday March 30th. If you are one of the 63 employees being sent away without any severance, come and make your voice heard. Our contributions over the decades will not be ignored simply because we fought to prevent these same types of mistreatment from our soon to be former employer.

Board Charges

As I state there are multiple board charges relative to the severance negotiations as well as charges against the changes that were immediately imposed after ratification of the contract.
I will upload the actual documents detailing the current charges that were filed on behalf of our shops and members.

Grievances

Most of the grievances filed with the company have emanated from our L.A. Shop and Executive Vice President, Keith Denson has presented them in the 1st and 2nd steps. Keith has requested information from the company to prepare our grievances to which the company has been extremely illusive in fulfilling our requests for info. We have a right to the information we request or the company is in violation of our rights. A board charge will be filed regarding this matter should we continue to have our requests for information denied. I also filed grievances which pertain to Hours and Overtime. Specifically, there are no 6 &1/2 nor 8 hour shifts anywhere in the contract yet the schedules do. The contract describes a shift as 7 hours (eg. 35 hours a week). The other grievance I filed pertains to 6th day overtime. In negotiations, it was stated that ONLY if you call in sick would you be ineligible for overtime pay on the sixth day worked.

De-Authorization Drive

Once again, certain individuals are soliciting signatures to de-authorize the union security and dues checkoff language of the contract. These individuals have obtained the signatures in violation of the law. Supervision was notified on several occassions that these individuals were approaching bargaining unit employees during work hours, on the floor, during the runs. There have been numerous accounts from members in which complaints of being exposed to potential safety hazards when signatures were being sought from them while performing work on the press equiptment.

The consequences of de-authorization would cripple the union's ability to defend its members. The company is very aware of this fact and would love nothing more than for this to occur. It would allow them to trample all over the remaining employees and the union would be financially unable to retain legal counsel. The Local would also be financially effected and unable to operate effectively enough to serve the membership. This is to the benefit of the company and not the employees. Don't support this campaign against the union.

Constitution & By Laws Meeting

Members of Local 140-N are requested to attend this meeting to review and adopt our constitution and by-laws that were approved by the constitution and by-laws commitee. The Committee was chaired by Exec. Vice President Keith Denson and the committee members are Mark Austin, Denise Kolm, Dan Beruman, Ed Padgett and Gary Bunch.

The meeting will be held on Saturday March 28, 2009 at the Crown Plaza Hotel, Commerce Casino at 2:30 pm. This meeting is restricted to members that submitted a fully completed Teamster Membership Application and Dues Check off Authorization.

This photo is a testament to the company's decades old and antiquated position of union busting, and the employees quest for fairness and equality.
I hope to have all these documents reviewed by the Teamsters Historical Department for proper preservation.

Touching a Nerve

All right, the Retch knows he's way late on this, but the Dan Neil et al. lawsuit seems to have touched a nerve. Who knew that Sam Zell -- more likely the thin-skinned Randy Michaels -- cared so much? First, check out the language of the email that Zell sent out to let employees know about the lawsuit:

There is a difference between questioning authority or challenging the "business as usual attitude," and maligning the company in public. That's just bad judgment and does no one any good. It's a distraction that's unnecessary.We are partners. We need to act like it. Sam, the time for "acting" like partners ended when you cursed at us; when you denigrated us; when you told us we were overhead; when you fired reporters; when you cut back newshole; when you deprived our readers of information about their lives to make the payments on your over-leveraged debt.

Partner, in case your dictionary knowledge is as lacking as your lackey's grammatical knowledge, is a word which implies equality. But you have never acted as an equal. We have no power. We have no say. We have never been consulted in a single action that you or any of your cronies have taken in dismantling the Tribune Co. So stop fucking call me your partner. It's patronizing. It's demeaning. And it's wrong.

Then there's the language of the actual press release. The lawsuit is filled with "frivolous and unfounded allegations." Yet Zell mentions not a one. And then he declares himself "outraged."I don't honestly know where this lawsuit will lead. And I fear that, like most lawsuits, it will be two, three, four years before we find out, by which time Sam will have looted the pension, driven off or fired the best workers and turned the Tribune Company into a television network featuring Bozo 90210 and a few newsletter-sized newspapers.

But I do know who should be outraged. And I know it's not Sam Zell.The attorneys response to Zell, in a similar vein, follows in his email to Tribune employees earlier today, Sam Zell dismissed the allegations against him and his co-fiduciaries as “frivolous and unnecessary.”
“We are partners,” the email continued, “we need to act like it.”This statement is a standard Zell response: lacking in specifics and filled with vitriol. The complaint is detailed and the allegations are correct. The complaint asserts that the Tribune ESOP has not provided the rank and file employees with a detailed justification for the Zell acquisition. Ask Sam: where’s the detailed justification? The Tribune pension administrators have not provided the retired Tribune employees with an explanation as to why the pension plan was supposedly over funded by $400 million. This explanation is particularly necessary given the current downturn in the stock market. Ask Sam: where’s the explanation?

The directors have established a conflict of interest policy for related party transactions. Ask Sam: explain how the conflict of interest policy has been followed with HIS relatives?The current and former Tribune employees are not “all in this together” with Sam Zell. The rank and file employees have their jobs and their current and future retirement plans tied up by the machinations of Zell and his co-fiduciaries. Their salaries are low and they see many of their colleagues being let go on a monthly basis. On the other hand, Sam Zell has billions of dollars and does not have his livelihood at stake. For example, Zell’s upcoming birthday party will feature The Eagles. Ask Sam: how many of his “partners” are spending their birthdays in a similar fashion?

Speaking of “maligning the company in public,” we ask that journalists covering this story consider Sam Zell’s prior comments denigrating print journalism. Imagine if the Chairman of Procter & Gamble stated: “I don’t use Ivory Soap. I hate Ivory Soap.” Despite it all, these newspapers are continuing to produce great journalism.Zell’s comments fail to acknowledge the billions of dollars in debt he caused the Tribune Company to incur, necessitating both the layoffs and the diminishing content of the Company’s newspapers. It is unfortunate that, in typical fashion, Sam Zell is ignoring the rights and neglecting the best interests of the hard-working Tribune employees, whom he cynically refers to as “partners.” Rather than working with his “partners,” he is tearing the company down, brick by brick, and selling it off, in an effort to pay down the massive debt he improperly encumbered the company with.

We look forward to cutting through Zell’s self-serving, out of touch rhetoric and fighting for our clients – the Tribune’s real and rightful owners – in court.In these turbulent times, fiduciaries must act in the best interests of their employees, particularly when they are the “owners” of the company. Zell and his co-fiduciaries have utterly failed to do so as more specifically described in the complaint.

Hey partners,
Funny, I don't feel much like a partner.That's because I'm one of the 63 presspeople getting laid off. After 31 years with the company I've been given my walking papers starting April 6.09

I started when I was 18 years old.My stepfather was a truck driver for the Times.He told me "I'll get you in the door, but after that it's up to you".I can walk away being proud of the job I've done.I always looked forward to the proud day when at 58 years old I could brag about being a 40 year employee.That's not going to happen now.


It's 4:00 am and I'm scribbling notes on paper before I sit down to the computer later and "peck" this in.I slept in late this morning.I've lately been waking up at 1:30 am and unable to go back to sleep with all the things on my mind.I'm out on disability after having surgery on my foot.I kept working thinking the problem would go away but the doctor said it wouldn't and would get worse.Now they are concerned about my blood pressure.Losing my job,having surgery,the proposed lousy severance,and lack of a plan for the future.No wonder it's high.
How about you Russ? You losing any sleep? How's your blood pressure partner?

I would've thought telling the story over and over again to my relatives,friends,neighbors and others would make it easier.But it doesn't.Luckily I have a supportive wife and family that look forward to the next chapter in our lives.Hopefully it doesn't involve working nights,weekends,holidays and driving 40 miles one way to work.
How about you Russ? When you tell the story about how your screwing 63 employees out of their severance over and over again does it make it easier to do partner?

Tribune co. is now employee owned.Sam Zell said "were partners". Where's Sam? I read somewhere that the bankruptcy judge gave the OK for bonus money for Tribune management deserved prior to bankruptcy. If they did such a fine job then why are we in bankruptcy? Hope all you partners didn't feel guilty about depositing those bonus checks into your bank accounts. I'll bet the total amount for those bonuses equals the total amount of severance your Not giving to the 63 presspeople.

How come most of my fellow pressroom employees that are not leaving are so quiet? Don't think that whatever happens to us won't happen to you next.Did Russ whisper in your ears" Don't worry. Next time there is a layoff you'll get the same severance as everyone else. We just want to screw these 63 employees. Promise". Have any of you thought about if management would have announced a better severance,they would have a mass exodus from higher seniority people? That would have enabled some of the 63 "pro union" people to stay? This is managements way of "busting" the union. Pretty smart partners.

Thirty one years. Seventeen years in Transportation and fourteen in the pressroom.Time sure went fast.I've always let my work speak for itself and I've always been a firm believer that if I do good things, good thinks will happen.The only thing that is fair is to give us what everyone else is getting. After all we are partners right?
In closing I'd like to thank the Los Angeles Times for the job that I loved and the opportunities that it provided. I'd like to thank all my friends and coworkers that helped me become the person that I am and the worker that I was. It was a partnership in life that I will forever be grateful for.
